Terms and Conditions Effective Date: August 12, 2026 Last Updated: August 12, 2026

These Terms and Conditions (“Terms”) govern your access to and use of LeverageYourBusinessOnline.com (the “Site”) and the consulting, creative, technical, educational, and related professional services offered through or in connection with the Site (collectively, the “Services”).

Please read these Terms carefully. By accessing the Site, submitting an inquiry, creating an account, scheduling a consultation, placing an order, accepting a proposal or estimate, paying an invoice or deposit, or otherwise engaging LYBO to provide Services, you acknowledge that you have read, understood, and agree to these Terms.

If you do not agree with these Terms, please do not use the Site or engage LYBO for Services.

1. About LYBO and the Two LYBO Service Channels

LYBO operates two related but distinct channels.

A. Consulting and Creative Services — LeverageYourBusinessOnline.com

This Site is the consulting, planning, creative, design, and hands-on service side of LYBO.

Services may include, without limitation:

  • Website design, development, redesign, and improvement
  • Digital and online-presence consulting
  • Website and online-presence reviews
  • Graphic design and graphic art
  • Branding and visual identity support
  • Presentation development
  • Photography and visual-content services
  • Website content and layout assistance
  • Technical setup and configuration assistance
  • Project planning and implementation guidance
  • Digital-business and online-presence education
  • Other creative, technical, or consulting services agreed upon with a client

The exact scope of a project will be determined by the applicable consultation, proposal, estimate, invoice, order, booking confirmation, statement of work, or other written agreement.

B. Digital Products — LYBO.biz

LYBO.biz is a separate digital-product storefront built on GoDaddy's platform.

Digital products and technology obtained through LYBO.biz—including domains, hosting, professional email, website builders, WordPress products, SSL and website security, e-commerce tools, scheduling products, marketing tools, backups, and related technology—may be supplied, hosted, provisioned, processed, or otherwise supported by GoDaddy or other third-party providers.

Purchases and use of those products are subject to the terms, privacy policies, refund policies, licensing conditions, renewal terms, and other agreements applicable to LYBO.biz, GoDaddy, and the relevant third-party provider.

These Terms primarily govern LYBO's consulting and creative Services and do not replace the terms applicable to products purchased through LYBO.biz.

Purchasing a product through LYBO.biz does not automatically include consulting, design, configuration, management, maintenance, or other professional services from LYBO unless expressly stated.

Likewise, hiring LYBO for consulting or creative Services does not automatically include the cost of domains, hosting, software, plugins, subscriptions, licenses, professional email, stock assets, or other third-party products unless expressly included in writing.

2. Eligibility and Authority

You must be at least 18 years old, or the age of legal majority where you reside, to enter into a paid Service engagement with LYBO unless a parent or legal guardian enters into the agreement on your behalf.

If you are engaging LYBO on behalf of a business, organization, nonprofit, professional practice, partnership, or other entity, you represent that you have authority to bind that entity to these Terms and any applicable project agreement.

3. Consultations, Estimates, Proposals, and Project Agreements

An initial conversation, inquiry, consultation, estimate, or discussion does not necessarily create an ongoing professional-services relationship.

Before substantial project work begins, LYBO may provide or require a proposal, estimate, invoice, project description, statement of work, written confirmation, or similar document establishing items such as:

  • Scope of work
  • Deliverables
  • Project price or hourly rate
  • Deposit or retainer
  • Estimated schedule
  • Revision allowances
  • Client responsibilities
  • Third-party expenses
  • Payment milestones
  • Cancellation terms
  • Maintenance or support arrangements

If a project-specific written agreement conflicts directly with these Terms, the project-specific agreement will control with respect to that project.

Unless expressly stated otherwise, estimates and anticipated completion dates are good-faith projections and not guarantees.

4. Scope of Services and Changes in Scope

LYBO will perform the Services described in the applicable project agreement or written understanding.

Requests that materially expand, alter, or add to the agreed scope may constitute additional work and may require:

  • A revised estimate;
  • An additional fee;
  • A revised timeline; or
  • A separate project agreement.

LYBO will make reasonable efforts to identify material scope changes before performing substantial additional billable work.

5. Client Responsibilities

Successful projects depend on timely and accurate client participation.

You agree, as reasonably applicable to your project, to:

  • Provide accurate project requirements and instructions;
  • Supply requested text, images, logos, credentials, files, approvals, and other materials;
  • Review work and provide feedback within a reasonable period;
  • Identify errors, omissions, or requested changes promptly;
  • Maintain access to necessary third-party accounts;
  • Keep applicable subscriptions, domains, hosting, licenses, and services in good standing;
  • Maintain backups of important business information and original source materials;
  • Obtain necessary legal rights and permissions for materials you provide;
  • Comply with laws and regulations applicable to your business, profession, website, advertising, products, and services.

Delays in receiving required information, approvals, access, files, content, or feedback may result in corresponding project delays.

6. Account Access and Credentials

Certain Services may require LYBO to access a client's website, domain, hosting environment, email administration, social platform, analytics service, website builder, content-management system, or other third-party account.

Whenever reasonably available, delegated account access or separate administrator credentials should be used instead of sharing a primary password.

You remain responsible for:

  • Maintaining ownership and control of your accounts;
  • Protecting your credentials;
  • Removing or changing LYBO's access when Services have concluded where appropriate; and
  • Maintaining appropriate account security and multi-factor authentication when available.

You should not submit passwords, Social Security numbers, complete payment-card information, protected health information, or other highly sensitive information through a general website contact form unless LYBO has specifically instructed you to use an appropriate secure method.

7. Fees, Deposits, and Payment

Service fees will be stated in the applicable proposal, estimate, invoice, booking, or other written agreement.

LYBO may require a deposit, retainer, milestone payment, or payment in full before beginning or continuing work.

Unless otherwise agreed:

  • Payments are due according to the applicable invoice or written payment schedule.
  • Third-party charges and expenses incurred specifically for a client may be billed separately.
  • Applicable taxes may be added where required.
  • Work may be paused when an account is materially overdue.
  • Additional work outside the agreed scope may be separately billed.

A deposit or advance payment may be applied toward time reserved, work performed, project preparation, research, purchased materials, or other commitments made for the project.

Any refund for work that has not been completed will be determined according to the applicable written project terms, work already performed, and nonrecoverable expenses or commitments already incurred.

Completed and accepted Services are generally not refundable merely because a client's business priorities, preferences, or circumstances later change.

Nothing in this section limits any non-waivable consumer rights provided by applicable law.

8. Cancellations, Rescheduling, and Project Inactivity

Cancellation and rescheduling requirements for appointments, consultations, photography, or other scheduled Services may be stated at the time of booking or in a project agreement.

If a client pauses or becomes unresponsive during a project, LYBO may adjust the project schedule or place the project on hold.

A project that remains inactive for an extended period may require rescheduling or a revised scope, timeline, or estimate before work resumes.

LYBO will make reasonable efforts to communicate before treating a project as inactive or terminated.

9. Revisions and Approvals

The number and type of revisions included in a project, if limited, will be stated in the relevant proposal or agreement.

A revision generally means a reasonable modification of work already created within the agreed scope. A new direction, new concept, substantial redesign, additional page, new functionality, or materially different deliverable may constitute additional work.

Clients are responsible for reviewing spelling, names, dates, pricing, contact information, factual claims, legal language, and other business information before final approval or publication.

10. Website Design and Development

Website projects may rely on third-party platforms, website builders, content-management systems, themes, templates, plugins, integrations, APIs, hosting services, fonts, stock assets, or other technology.

The availability, functionality, licensing, portability, pricing, compatibility, security, or continued operation of those third-party components is governed by their respective providers.

Unless expressly included in writing, completion of a website project does not include perpetual:

  • Hosting
  • Domain registration
  • Website maintenance
  • Software updates
  • Security monitoring
  • Content updates
  • Backup services
  • Search-engine optimization
  • Accessibility monitoring
  • Technical support
  • Plugin or software subscriptions

Ongoing services may be purchased or arranged separately where available.

11. Third-Party Products and Services

LYBO may recommend or assist with third-party services because they appear appropriate for a client's objectives.

A recommendation does not constitute a guarantee of the third party's performance, availability, security, pricing, continued operation, or suitability for every circumstance.

Third-party providers may change their products, pricing, features, terms, APIs, algorithms, availability, or technical requirements without LYBO's control.

You are responsible for reviewing and complying with the terms applicable to third-party products and maintaining required subscriptions and licenses.

12. Search Engines, Social Platforms, Marketing, and Business Results

LYBO may provide guidance or Services relating to websites, SEO, online visibility, branding, content, social media, email marketing, digital strategy, audience development, or similar areas.

Results are influenced by numerous factors outside LYBO's control.

Accordingly, LYBO does not guarantee:

  • Search-engine rankings;
  • Website traffic;
  • Social-media reach or engagement;
  • Followers or subscribers;
  • Leads or inquiries;
  • Sales or revenue;
  • Conversion rates;
  • Advertising performance;
  • Platform approval;
  • Continued placement in search results;
  • Specific business or financial outcomes.

Any forecasts, observations, ideas, or recommendations are professional judgments based on information available at the time and should not be interpreted as promises of future performance.

13. Consulting and Educational Information

LYBO provides digital, creative, technical, and business-oriented guidance within its areas of experience.

Unless expressly agreed otherwise in writing, LYBO is not acting as your attorney, accountant, tax adviser, financial adviser, insurance professional, compliance officer, cybersecurity auditor, or other regulated professional.

Information provided through consultations, the Site, newsletter, blog, Wisdom & Wi-Fi programming, or other educational materials is general informational guidance and should not replace professional advice appropriate to your circumstances.

14. Legal and Regulatory Compliance

You are responsible for determining the legal and regulatory requirements applicable to your business and website.

Unless specifically included in a written scope of work, LYBO does not warrant that a website, document, marketing campaign, or digital system complies with every requirement relating to:

  • Privacy and data protection;
  • Website accessibility;
  • Industry-specific advertising;
  • Healthcare or HIPAA;
  • Payment-card or PCI requirements;
  • Financial-services regulations;
  • Professional licensing;
  • Consumer disclosures;
  • Copyright or trademark clearance;
  • Employment law;
  • Tax law;
  • International law; or
  • Other specialized regulatory obligations.

LYBO may provide general templates, information, or practical implementation assistance, but legal documents and compliance decisions should be reviewed by qualified counsel where appropriate.

15. Client Materials and Representations

“Client Materials” means text, photographs, graphics, trademarks, logos, video, audio, data, business information, documents, files, or other materials supplied by or on behalf of a client.

You retain your ownership rights in Client Materials.

You grant LYBO a limited, non-exclusive license to use, reproduce, edit, resize, adapt, transmit, or otherwise process Client Materials as reasonably necessary to perform the Services.

You represent that you own or have obtained sufficient rights and permissions to provide those materials and authorize their use.

You agree not to require LYBO to knowingly create, publish, transmit, or distribute unlawful, defamatory, fraudulent, infringing, malicious, or otherwise illegal content.

16. Intellectual Property and Final Deliverables

Unless a project agreement states otherwise:

Client Materials

The client retains ownership of materials supplied by the client.

Custom Final Deliverables

After LYBO has received full payment for the applicable project, the client receives the ownership or usage rights expressly stated in the project agreement for final custom deliverables created specifically for that client.

LYBO Background Materials

LYBO retains ownership of its pre-existing materials, processes, methodologies, know-how, reusable components, templates, design systems, concepts, techniques, workflows, tools, and other intellectual property developed independently of the specific project.

Where LYBO background materials are incorporated into a final deliverable, the client receives a reasonable license to use them as part of the completed deliverable for its intended purpose unless otherwise stated.

Third-Party Materials

Fonts, stock photographs, music, software, plugins, templates, themes, platform components, AI tools, code libraries, or similar third-party materials remain subject to their respective licenses.

Preliminary and Unused Work

Unless expressly purchased or transferred, preliminary concepts, unused designs, working files, rejected concepts, experiments, drafts, and internal production materials remain the property of LYBO.

17. Portfolio and Promotional Use

Unless confidentiality has been agreed to in writing or the client requests otherwise before public display, LYBO may identify publicly launched or publicly distributed final work as work performed by LYBO and may display reasonable examples in portfolios, case studies, social media, presentations, or marketing materials.

LYBO will not intentionally disclose confidential client information merely for portfolio purposes.

A client may request in writing that otherwise nonpublic work remain confidential.

18. Confidential Information

During a project, either party may receive business, technical, creative, financial, operational, or other information that is reasonably understood to be confidential.

Each party agrees to use reasonable care to protect the other party's confidential information and to use it only as reasonably necessary for the applicable relationship.

Confidential information does not include information that:

  • Is or becomes publicly available without breach of an obligation;
  • Was lawfully known before disclosure;
  • Is independently developed without use of the confidential information;
  • Is lawfully obtained from another source without confidentiality restrictions; or
  • Must be disclosed by law, court order, or governmental requirement.

A separate nondisclosure agreement or project agreement may provide additional confidentiality requirements.

19. Website Accounts

If the Site permits you to create an account, you are responsible for maintaining accurate account information and the confidentiality of your sign-in credentials.

You are responsible for activity occurring through your account unless caused by circumstances for which you are not legally responsible.

Notify LYBO promptly if you believe your Site account has been accessed without authorization.

LYBO may suspend or restrict an account when reasonably necessary to address suspected fraud, abuse, security concerns, legal requirements, or material violations of these Terms.

20. Acceptable Use of the Site

You may not use the Site to:

  • Violate applicable law;
  • Infringe another person's intellectual-property or privacy rights;
  • Transmit malicious code or harmful software;
  • Attempt unauthorized access to the Site or connected systems;
  • Interfere with Site security or operation;
  • Harvest personal information without authorization;
  • Submit fraudulent information;
  • Impersonate another person or organization; or
  • Use automated methods in a manner that materially disrupts the Site.

21. Communications and Newsletter

When you voluntarily subscribe to LYBO's newsletter or promotional communications, LYBO may send updates, educational information, promotions, security notices, product information, service information, and other communications consistent with your subscription.

You may unsubscribe from marketing emails using the unsubscribe mechanism provided in the message or another method made available by LYBO.

Transactional, account, security, billing, project, and service-related communications may still be sent when reasonably necessary for an existing relationship.

22. Privacy

Use of the Site and Services is also subject to LYBO's Privacy Policy, which explains how LYBO collects, uses, protects, and discloses personal information.

Third-party platforms and services are governed by their own privacy notices.

23. Service Availability

LYBO makes reasonable efforts to keep the Site and Services available but cannot guarantee uninterrupted or error-free operation.

Temporary disruptions may occur because of maintenance, updates, internet outages, hosting problems, third-party service interruptions, security incidents, equipment failures, or circumstances outside LYBO's reasonable control.

24. No Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ANY INFORMATION MADE AVAILABLE THROUGH IT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

LYBO WILL PERFORM PAID PROFESSIONAL SERVICES IN A PROFESSIONAL AND REASONABLE MANNER CONSISTENT WITH THE APPLICABLE PROJECT AGREEMENT.

EXCEPT FOR EXPRESS COMMITMENTS MADE IN WRITING, LYBO DISCLAIMS IMPLIED WARRANTIES TO THE MAXIMUM EXTENT PERMITTED BY LAW, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

NOTHING IN THESE TERMS EXCLUDES WARRANTIES OR RIGHTS THAT CANNOT LAWFULLY BE DISCLAIMED.

25. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LYBO WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST BUSINESS OPPORTUNITIES, LOST DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION ARISING FROM OR RELATING TO THE SITE OR SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LYBO'S AGGREGATE LIABILITY ARISING FROM A PARTICULAR PAID PROJECT OR SERVICE WILL NOT EXCEED THE AMOUNT ACTUALLY PAID TO LYBO FOR THE PROJECT OR SERVICE GIVING RISE TO THE CLAIM.
